These Terms and Conditions (?Agreement?) govern the use of services and products provided by Kfaith Holdings (Pty) Ltd (?Company?, ?we?, ?us?). By accessing our software, SaaS platforms, or engaging our development services, you (?Client?, ?User?) agree to these terms.
2. Services
We provide:
Software-as-a-Service (SaaS) products
Custom software development
Web and mobile application development
Technical consulting and support
Specific details will be defined in a Service Level Agreement (SLA) or Statement of Work (SOW).
3. SaaS Usage
Access is granted as a limited, non-exclusive, non-transferable license
Users must not:
Reverse engineer or copy the platform
Use the service for unlawful purposes
Attempt to gain unauthorised access
We reserve the right to suspend accounts for violations.
4. Client Responsibilities
Clients must:
Provide accurate information
Ensure lawful use of software
Maintain confidentiality of login credentials
Comply with applicable South African laws
5. Fees and Payment
Pricing is defined in agreements or on our website
SaaS subscriptions are billed monthly or annually
Custom development may require deposits
Late payments may result in service suspension
All amounts are in South African Rand (ZAR) unless stated otherwise.
6. Intellectual Property
SaaS products remain the property of Kfaith Holdings
Custom-developed software ownership transfers only after full payment (unless otherwise agreed)
We retain rights to the underlying frameworks, code libraries, and tools
7. Data Protection & Privacy
We comply with the Protection of Personal Information Act (POPIA).
Use of our services is also governed by our Privacy Policy.
8. Confidentiality
Both parties agree to protect confidential information and not disclose it without consent.
9. Warranties & Disclaimers
Services are provided ?as is?
We do not guarantee uninterrupted or error-free service
We are not responsible for third-party integrations or failures
10. Limitation of Liability
To the fullest extent permitted under South African law:
We are not liable for indirect or consequential damages
Liability is limited to the total fees paid by the Client
11. Termination
We may suspend or terminate services if:
Terms are breached
Payments are not made
Illegal activity is detected
Clients may terminate with written notice as per the agreement.
12. Force Majeure
We are not liable for delays caused by events beyond our control.
13. Governing Law
This Agreement is governed by the laws of the Republic of South Africa.
14. Dispute Resolution
Disputes shall first be resolved amicably. If unresolved, they may be referred to arbitration in South Africa.
